3. User Responsibilities & Eligibility
Eligibility: You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.
Account Integrity: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Violation of these rules may result in immediate termination of your account and access to the Services, at our sole discretion.
4. Intellectual Property Rights
The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by NaughtyDate, its licensors, or other providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The "NaughtyDate" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of NaughtyDate or its affiliates or licensors. You must not use such marks without the prior written permission of NaughtyDate.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. No right, title, or interest in or to the Services is transferred to you.
5. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall NaughtyDate, its affiliates, directors, employees, licensors, or service providers be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to damages for loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or system failure, arising out of or in connection with:
- Your use of, or inability to use, the Services.
- Any conduct or content of any third party on the Services, including without limitation any defamatory, offensive, or illegal conduct of other users.
- Any content obtained from the Services.
- Unauthorized access, use, or alteration of your transmissions or content.
Our total cumulative liability to you for all claims arising from or related to the Services shall not exceed the greater of (a) the amount you have paid to NaughtyDate in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).
Disclaimer: This limitation of liability is a fundamental element of the basis of the bargain between you and NaughtyDate and shall apply even if the above-stated remedy fails of its essential purpose.
6. Disclaimer of Warranties
YOUR USE OF THE SERVICES AND THEIR CONTENT IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NAUGHTYDATE EXPLICITLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Services will be uninterrupted, secure, error-free, or free from harmful components. We do not warrant the accuracy, completeness, or reliability of any content or communications provided through the Services. We are not responsible for the conduct, online or offline, of any user of the Services.
7. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
You may terminate your account at any time by contacting our support team or using the account deletion tools within the Services.
8. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts located in London, England. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Services.

11. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and NaughtyDate regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
